Agreement to Terms

By accessing or using LeedAgent ("Service," "Platform," or "LeedAgent"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

LeedAgent is a sales and operations platform for insurance and real estate teams. The Service includes website publishing, CRM and pipeline management, a unified conversations inbox, telephony and dialer, email and SMS automation, booking calendar, analytics, and AI-powered tools.

Account Terms

Account Creation

  • You must provide accurate, complete, and current information
  • You must be at least 18 years old to use this Service
  • You are responsible for maintaining account security
  • You are responsible for all activities under your account
  • One person or legal entity may maintain only one free account

Account Security

  • You are responsible for safeguarding your password
  • You must notify us immediately of any unauthorized access
  • You must not share your account credentials
  • You must not create accounts for others without permission

Account Types

  • Starter ($29/mo): designed for individuals and early-stage users with core CRM, publishing, calendar, conversations, and communication tools with plan-defined limits.
  • Professional ($59/mo): designed for growing operators who need higher limits, expanded automation, AI-powered features, A2P compliance tools, and an Industry Starter Kit with pre-built websites, workflows, and templates.
  • Agency ($99/mo): designed for teams and multi-client usage, including white-label branding, REST API access, team collaboration, advanced AI, and all starter kits.

Industry Starter Kits

Professional and Agency plans include access to pre-built Industry Starter Kits. These kits provision website pages, automated workflows, appointment types, and message templates specific to your industry. Starter Kit content is provided "as-is" and may be customized by you after provisioning. Kit availability varies by industry mode.

Acceptable Use Policy

You May

  • Build and publish websites, landing pages, and booking pages
  • Use CRM tools to manage contacts, leads, and pipeline
  • Send emails and SMS messages to opted-in contacts
  • Make and receive voice calls through the built-in phone system
  • Use AI tools to generate content and assist workflows
  • Connect custom domains to your published sites
  • Build and run automated follow-up workflows
  • Run A/B tests on your pages

You May Not

  • Violate any laws or regulations
  • Send unsolicited messages (spam) via SMS, email, or voice
  • Abuse, harass, threaten, or impersonate others
  • Distribute malware, viruses, or harmful code
  • Attempt to breach security measures
  • Scrape or copy other users' content
  • Resell the Service without authorization
  • Circumvent usage limits or restrictions
  • Reverse engineer the platform
  • Use telephony features to violate TCPA, A2P 10DLC, or other telecom regulations

Content Guidelines

  • You are responsible for all content you create and messages you send
  • Content must not violate intellectual property rights
  • Content must not contain hate speech or discrimination
  • Content must not promote illegal activities
  • Content must comply with applicable laws

Telephony and Messaging

SMS and Voice

  • You must comply with all applicable telecom regulations including TCPA and A2P 10DLC
  • You must obtain proper consent before sending SMS messages or making calls
  • You are responsible for maintaining accurate Do Not Call (DNC) lists
  • Telephony usage is billed based on provider rates plus applicable platform fees
  • A2P 10DLC campaign registration is required for SMS sending and involves one-time and monthly provider fees

SMS Terms for Message Recipients

If you receive SMS messages from a business using LeedAgent, the following applies:

  • Messages are only sent to individuals who have provided prior express written consent
  • Message frequency varies based on your account activity and service interactions
  • Message and data rates may apply. Contact your mobile carrier for details
  • Consent to receive text messages is not a condition of purchase or use of any service
  • You may opt out at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation and no further messages will be sent
  • For help, reply HELP to any message or contact the sending business directly
  • Phone numbers and opt-in data are not sold, rented, or shared with third parties for their marketing purposes
  • Carriers are not liable for any delayed or undelivered messages

Service Limits and Usage

Starter Plan Limits

  • Core CRM, publishing, and communication features
  • Plan-defined allowances for sites, contacts, messages, and storage
  • Community support and documentation

Professional Plan Limits

  • Higher usage allowances across all features
  • Expanded analytics, automation, and telephony capabilities
  • Priority email support

Agency Plan Limits

  • Highest plan allowances for multi-brand and team workflows
  • White-label, API access, and team collaboration features
  • Dedicated support

Fair Use Policy

We reserve the right to throttle or suspend accounts that:

  • Exceed reasonable usage patterns
  • Impact service stability
  • Violate acceptable use policies
  • Abuse AI generation or telephony features

Payment Terms

Billing

  • Plans are billed monthly or annually
  • Prices are in US Dollars (USD)
  • Payment is due at the start of each billing cycle
  • We use Stripe for secure payment processing
  • Telephony and provider fees are charged separately via wallet balance

Starter Plan

  • Trial terms and first-charge terms follow your selected plan details
  • Can upgrade to a higher plan at any time

Refunds

  • Monthly plans: No refunds for partial months
  • Annual plans: Pro-rated refunds within 14 days of initial purchase
  • Service credits may be issued for significant downtime
  • Submit refund requests through the LeedAgent contact page

Plan Changes

  • Upgrades: Effective immediately, pro-rated billing
  • Downgrades: Effective at next billing cycle
  • Downgrading may result in loss of access to features exceeding new plan limits
  • You will be notified before any data loss occurs

Late Payment

  • Service may be suspended for non-payment
  • Account may be downgraded to the lowest available active plan
  • Account termination after 30 days of non-payment

Service Availability

Uptime

We strive to maintain 99.9% uptime but make no guarantees. Service may be unavailable due to:

  • Scheduled maintenance
  • Third-party service issues
  • Internet connectivity problems
  • Force majeure events

Scheduled Maintenance

  • Announced 24 hours in advance when possible
  • Typically during low-usage periods
  • Critical security updates may be applied immediately

Health Data and Regulatory Compliance

No Protected Health Information (PHI)

LeedAgent is a sales CRM and does not store, process, or transmit Protected Health Information (PHI) as defined by HIPAA. The platform is designed for lead management, follow-up, and client relationship tracking — not for managing medical records, health conditions, or insurance policy administration (AMS).

What We Do Store

  • Contact information (name, email, phone, address, date of birth)
  • Sales pipeline and opportunity data
  • Communication history (emails, SMS, call logs)
  • Appointment and calendar data
  • Published website and form submission content

What We Do NOT Store

  • Social Security Numbers (SSN)
  • Medical conditions or health records
  • Prescription or medication information
  • Insurance policy details (as a covered entity)
  • Any data classified as PHI under HIPAA

Future HIPAA Compliance

We are actively developing HIPAA-compliant capabilities that will be offered as a premium feature in the future. Once available, users who require PHI storage will be able to upgrade to a HIPAA-enabled tier with field-level encryption, audit logging, and Business Associate Agreement (BAA) coverage. Until then, do not enter PHI into the platform.

Industry Regulations

If you operate in a regulated industry (insurance, real estate, lending), you are responsible for ensuring your use of LeedAgent complies with applicable federal and state regulations, including but not limited to TCPA, CAN-SPAM, A2P 10DLC, state insurance regulations, and fair lending laws.

Content and Data

Your Content

  • You retain full ownership of all content you create
  • You grant us license to host and display your published content
  • You are responsible for backing up important content
  • You must have rights to any content you upload

Our Responsibilities

  • Implement reasonable security measures
  • Encrypt data in transit and at rest
  • Maintain backups for disaster recovery
  • Comply with applicable privacy laws

Published Content

  • Pages you publish are publicly accessible
  • Published content may be indexed by search engines
  • You can unpublish or delete pages at any time
  • Deleted content is removed within 24 hours

Data Export

  • You can export your data at any time
  • Contact support for bulk data exports

Data Deletion

  • Account deletion removes all data within 30 days
  • Published pages are taken offline immediately
  • Backups are purged after 90 days

Intellectual Property

Our IP

  • LeedAgent platform, code, templates, and design are our property
  • You may not copy, modify, or distribute our IP
  • Our trademarks may not be used without permission
  • Templates are licensed for use within the platform only

Your IP

  • You retain all rights to content you create
  • You grant us license to display and host your content
  • We do not claim ownership of your content
  • Content created with AI tools belongs to you

AI-Generated Content

  • Content generated using our AI tools is owned by you
  • You are responsible for reviewing AI-generated content before use
  • We do not guarantee originality of AI-generated content
